The lawyer of the Tibetan Cabinet Lobsang Dakpa failed to appear before the Tibetan Supreme Justice Commission for a hearing concerning his terming the Court’s judgment in Case no 20 as biased.
Dakpa was summoned to answer contempt of court charges instituted against him by plaintiff Penpa Tsering.
Since the lawyer did not show up by 2:30 pm, the court was adjourned at 2:55 pm. A court official announced a new hearing date for 9 December at 10:30 am.
The official explained that Dakpa was notified via both an email and a letter dated 22 November, which were received by his Tibetan Legal Association office.
“His office signed after receiving the letter, but we didn’t get any acknowledgment from Lobsang Dakpa himself,” another court official told Tibet Sun.
Lobsang Dakpa, who is a member of the Tibetan Parliament-in-exile, was on an official European tour of France, Belgium, and The Netherlands in November.
Tibet Sun has learned that he has returned, and was seen today on the premises of the Central Tibetan Administration.

Members of Tibetan Parliament in exile, starting from Chitue Dawa Tsering and now this Mr. Lobsang Dakpa, are setting a very bad precedent. How will the public in general abide by the rulings of the TSJ if they, who legislate laws, don’t abide by it. Contempt of court should invite immediate cancellation of the membership of TPIE.
Lawyer of LS, the self claimed expert of law from Harvard University doesn’t know that oath he took as a lawyer is to tell the truth, the whole truth, nothing but the truth and to accept the verdict of Supreme Justice Commission as final arbiter of the case.
The lawyer also happen to be a Chithue, member of parliament. He doesn’t know that the oath he took as MP is uphold the constitution and supremacy of rule of law!
Now tell us: Who is undermining Tibetan Democracy? LS and his bokora lawyer. When the two didn’t get “my way is the right way” verdict, they refuses to honor the supremacy of Justice Commission. Oaths they took in the name of Buddha, Dharma, Sangha means nothing to them.
Disqualify this lawyer from lawyering any future cases in front of SJC and impeach him from being a MP. Shame! for undermining Tibetan democracy and constitution. But we the people won’t allow it. On my dead body. Because, this institution is built by the sweat and blood of my parents and their generation which includes many, many brave and honest Khampas.
no one is above the law but we are in exile the judges are old man and they doesn’t have knowledge about law and way they did for case no 20 is not fair decide. that’s why he didn’t accept the judges decision, but that doesn’t mean kashag didn’t respect the law. so always think wide and check about everything before you write something brother.
The whole judicial system of exile governance was a mockery once earlier and now with this so called case No. 20 again. Legally this case wasn’t ab initio maintainable before any court of law and shall be subject to dismissal in limine after preliminary adjudication. However, the so-called learned Tibetan legal luminary with their partisan nature and shallow wisdom allowed such matter and ultimately miscarriage of a judgment was inevitable.
It’s nothing but a few people who are dictating the whole judicial commission of Tibetans in exile and making their own rules and procedural laws, as if we all know nothing about law. LMAO
It’s high time thy shall stop all this nonsense and think apolitical and for greater goal concerning Tibet and its cause. Thank god, CTA till date haven’t appealed or approached actual court of Indian law on this matter, don’t know what is stopping them. Then they will know what is like suing and being sued! BHOE GYALO
If he can’t appear due to some conflicting schedules, then Lobsang Dakpa could hire a lawyer to represent him for the contempt hearing or to seek adjournment. This is a contempt hearing for his act of contempt and he will be personally liable for the act committed by him, any fines or punishment imposed on him shall be borne by him alone and not by Kashag.
If he does not appear again, then he will be proceeded ex parte and punished under contempt of court provision. He may be asked to offer butter lamps and clean the temple or McLeod Street or do 100 prostrations. If he does not obey the contempt order, then he may face bigger punishment that his voting right may be withheld for failure to fulfill the duties of a Tibetan citizen to obey the laws of CTA.
